Contrary to popular beliefs and television portrayals of lawyers living a life of luxury, prestige, and happiness, everyone in the legal profession is not thriving. Instead, the profession is at a tipping point, and if critically important changes are not made soon to how lawyers do business, take care of client matters, and take care of themselves, the profession could be headed toward a crisis.
For some, sounding this alarm may be akin to crying wolf. After all, this is certainly not the first time the alarm has been triggered or that critics have claimed the profession to be “lost,” “in crisis,” or in “decline.” (Harper, 2013, Moliterno, 2013, Trotter, 2012, Fleming, 1997, Gelennin, 1994, Kronman, 1993) In this case, however, the facts speak for themselves.
In the 2023 ALM Mental Health Survey of the Legal Profession seeking data regarding the well-being of lawyers and staff at law firms of all sizes anywhere in the world, the results provided below show that nearly 50% of the 3,000 attorney survey respondents believe the mental health problems and substance abuse issues in the legal industry are at a crisis level.
For a profession dependent on public trust and confidence in lawyer’s competence, crisis level mental health issues like this simply isn’t acceptable. Moreover, the status quo doesn’t provide a foundation for a sustainable future for the profession.
In addition, over 50% of survey respondents reported feeling a sense of failure and nearly 40% felt hopeless and trapped. Approximately 35% reported feeling detached and alone. Over 30% reported that they had lost their motivation. More than 50% indicated that they felt increasingly cynical. A whopping 65% said they had mental and physical overwhelm and fatigue and over 60% reported experiencing moodiness and irritability. Over 25% reported feeling like they had an inability to make decisions and over 20% reported they were withdrawing from support. Nearly 20% of survey respondents reported feeling hopeless. An amazingly high 70% of respondents reported feeling exausted. Nearly 25% percent reported that they hated thier jobs. Over 60% reported having trouble concentrating.
When asked about whether they felt thier work environment contributed to thier well-being issues, a colossal 76% responded yes, their work environment indeed contributed to their mental health problems.
Unfortunately, this data comes as no surprise because the truth is that for many years the legal profession has been plagued by large numbers of lawyers who are needlessly suffering from the physical and psychological tolls placed upon them by the profession. Common lifestyle choices and personality traits among large groups of lawyers may also contribute to a lawyer’s mental health issues and lack of job satisfaction. (Brafford, 2014)
As a profession, if lawyers continue to ignore, or worse yet, sweep these issues under the rug, they will continue to get worse. If they do, lawyers and the children and families of lawyers will also continue to needlessly suffer, and lives will continue to be lost.
